Terms of Use.

The terms on which Motark Enterprise Limited makes this website available to B2B visitors. This is an informational site — commercial supply is governed by separate written contract.

01 · Scope

What these terms cover.

These terms govern your use of the Motark Enterprise website at motarkenterprise.com (the “Site”). They do not constitute, and should not be read as, a commercial supply agreement, a licensing arrangement, or any other binding commercial contract — those are entered into separately in writing.

Informational website only

The Site is informational. It is intended for prospective and existing B2B counterparties — ingredient distributors, supplement manufacturers, pharmaceutical R&D partners, regulatory professionals, and qualified institutional reviewers.

Not a sales channel

No products are sold or fulfilled through the Site. Sample requests, wholesale enquiries, and licensing enquiries submitted via the contact form initiate a separate offline workflow, subject to counterparty verification and a written contract before any supply occurs.

Not directed at consumers

The Site is not directed at individual consumers and the compounds described are not offered for direct retail sale. Where you arrive from a consumer-oriented search, please note that Motark does not supply individual end-users.

02 · Use

Acceptable use.

You may browse, read, and reference the Site freely for legitimate B2B purposes. The following are not permitted:

No automated scraping or harvesting

Automated collection of Site content, contact details, or compound data — beyond what is published in robots.txt for recognised search engines — is not permitted.

No misuse of forms or contact channels

Contact forms, sample requests, and the Updates signup must be used in good faith. Submission of false counterparty details, attempted exploitation of the security middleware, or automated abuse is prohibited and may result in blocking and, where appropriate, referral to authorities.

No re-publication of substantive content without permission

Compound monographs, regulatory commentary, and Insights articles are produced by Motark’s technical team. Brief quotation with attribution is welcome; re-publication of substantive content requires prior written permission.

03 · No claims

Botanical compounds — no health or therapeutic claims.

Information published on the Site about Motark's compounds is provided for B2B technical, regulatory, and commercial reference. It is not intended to, and does not, make any of the following:

No medical or therapeutic claims

Nothing on the Site constitutes a claim that any compound diagnoses, treats, cures, mitigates, or prevents any disease, in any jurisdiction. Counterparties formulating finished products are solely responsible for the claims made on those products and for the regulatory pathway in their market.

No nutritional or structure/function claims

Where compound monographs reference traditional use or published research, this is historical and scientific context only. It does not constitute a nutritional, structure/function, or comparable health claim.

No advice to end-consumers

The Site does not provide medical, nutritional, or other professional advice to individuals. Individuals should consult a qualified healthcare professional for personal health questions.

04 · Supply

Commercial supply governed by separate written contract.

Where a counterparty engagement progresses to commercial supply, sample shipment, or licensing, that arrangement is governed by a separate written contract between Motark Enterprise Limited and the counterparty. The following always apply, irrespective of any content published on the Site:

Importer of record

The counterparty is the importer of record into the destination jurisdiction and is responsible for compliance with applicable import, customs, labelling, and registration requirements.

Counterparty verification before supply

All commercial engagements are subject to Motark's counterparty verification workflow. See the AML/KYC section on Operations & Compliance for detail.

Jurisdictional limitations

Certain compounds have jurisdiction-specific regulatory status. Motark will not supply where a destination requirement cannot be met. The per-compound regulatory tables on this Site reflect current status to the best of our knowledge but are not a substitute for counterparty due diligence in the importing market.

05 · Intellectual property

Site content and trade marks.

All content on the Site — including text, photography, illustrations, compound monographs, Insights articles, the Motark word mark, and the Motark logo — is the property of Motark Enterprise Limited or its licensors and is protected by Hong Kong and international intellectual property law.

Limited licence to view and reference

You are granted a non-exclusive, non-transferable, revocable licence to access the Site for legitimate B2B information and evaluation purposes only.

No implied rights

No rights are granted to use any Motark trade mark, logo, or proprietary content for commercial, promotional, or advertising purposes without prior written permission.

Third-party links

The Site contains outbound links to third-party resources (e.g. PubChem records, analytical-laboratory websites, third-party privacy policies). Those resources are governed by their own terms and Motark accepts no responsibility for their content.

06 · Disclaimers

Information published on an "as is" basis.

Motark publishes the Site in good faith and takes reasonable care that information is accurate at the time of publication. The Site is nevertheless provided on an "as is" and "as available" basis. To the maximum extent permitted by Hong Kong law:

No warranties

Motark makes no warranties or representations of any kind, express or implied, as to the completeness, accuracy, currency, suitability, or availability of any content on the Site, including regulatory status by jurisdiction, which can change without notice.

Counterparty must verify

Counterparties making sourcing, formulation, or regulatory decisions should verify all material information directly with Motark and with the applicable regulators in their destination markets before acting on it.

No liability for indirect loss

Motark accepts no liability for any indirect, consequential, special, or incidental loss or damage arising from the use of, or inability to use, the Site, including business interruption, loss of revenue, or loss of opportunity.

07 · Governing law

Hong Kong law and jurisdiction.

These terms are governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. Any dispute arising out of or in connection with these terms is subject to the exclusive jurisdiction of the Hong Kong courts.

08 · Changes

Updates to these terms.

We may update these terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site after an update constitutes acceptance of the revised terms.
